This Limited Warranty Policy (the “Warranty”) is made and effective January 01^st 2014

 

BETWEEN:                  

 

AND:                             

Buyers of Watches (the “Product(s)”) from the Company

Hereinafter referred to as “Customer”

WHEREAS, the Company is offering a collection of watches under the Brand “Matt Arend Timepieces” as seen on the company website www.matt-arend.co.za 

WHEREAS, the Customer has purchased one or more product(s) from the Company. 

NOW THEREFORE, in consideration of the mutual promises set forth, the parties agree as follows:

 

LIMITED WARRANTY  

The Company warrants that (a) the product(s) purchased will perform substantially as advertised for a period of 180 days from the date of receipt and (b) that the mechanical components of the products are free from defects in materials and workmanship at the time of purchase. 

This limited warranty policy covers the following components of the product for the below timeframes: 

• The Watch Mechanical Movement and internal mechanical defects of the movement for 30 Days from the Date of Purchase 
• Hands, Pins and Buttons coming lose and falling off within 30 Days of the Purchase 
• Cracked Glass and torn leather straps if reported within 3 Days of Delivery/Arrival/Handover of Product 

In the event applicable laws of South Africa imposes any implied warranties, the implied warranty period is limited to 180 days from the date of receipt.

 

CUSTOMER REMEDIES  

The Company’s and its suppliers’ entire liability and Customer’s exclusive remedy shall be, at the Company’s option, either (a) return of the price paid for the product, or (b) repair or replacement of the product that does not meet this Limited Warranty and which is returned to the Company with a copy of Customer’s purchase receipt. 

This Limited Warranty is void if failure or defects of the product have resulted from accident, abuse, misapplication or non-adherence to the Matt Arend Timepieces Instruction / Owner’s Manual.

Any replacement product will be warranted for the remainder of the original warranty period or 90 days, whichever is longer.

 

TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAWS OF SOUTH AFRICA THE COMPANY AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE PRODUCT AND ANY RELATED WRITTEN MATERIALS. THIS LIMITED WARRANTY GIVES CUSTOMER SPECIFIC LEGAL RIGHTS.

 

TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAWS OF SOUTH AFRICA, IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES FOR PERSONAL INJURY, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS PRODUCT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, THE COMPANY’S AND ITS SUPPLIERS’ ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE PRODUCT. 

IN WITNESS WHEREOF, the parties have entered into this Agreement through a legally binding sale of the product to the customer with full knowledge of its content and significance and intending to be legally bound by the terms hereof.
